HDB bedroom rentals: approval, owner-stay, and illegal partitions

How HDB whole-flat vs bedroom rentals differ for EP/DP tenants — continuous occupation rules, asking for the approval letter, partitioned living rooms, and deposit leverage when the setup is unlawful.

Heartland room rents look cheap until the setup is an unauthorised bedroom rental, a partitioned living room, or an “owner” who actually lives in JB and visits on Sundays. HDB’s rules are stricter than private-condo roommate culture — and tenants get caught in the cleanup when HDB revokes approval.

The continuous-occupation trap

HDB is explicit: locking a room “for the owner” while living elsewhere (Malaysia, another flat, hotel) is not continuous occupation. If owners stop living in the flat, bedroom-rental approval can be automatically revoked and the arrangement treated as unauthorised whole-flat rental.

Forum heat (owner stays but visits weekly): ask, in writing, where the owner sleeps most nights. A Sunday drop-in is a red flag, not a quirk.

Illegal partitions and “creative” rooms

Living-room plywood partitions rented as bedrooms are a recurring r/askSingapore nightmare (partition room legality). Treat as high risk:

  • Fire / escape and HDB alteration rules often make the setup unlawful
  • No proper room key / landlord enters freely → quiet-enjoyment and safety issues
  • Contracts purporting to lease an illegal room can fail hard when disputes reach SCT or higher courts — illegality arguments cut both ways; get advice for large deposits

Practical pre-LOI tells: missing window, no real door/lock, kitchenette carved out of the living room, more unrelated adults than the flat type allows.

What to demand before you pay

  1. HDB approval / registration letter naming you as authorised tenant (owners can apply online; outcome is often immediate for bedrooms)
  2. TA clause: tenancy is conditional on valid HDB approval for the whole term
  3. Written owner-occupation statement for bedroom rentals
  4. Pass copies with enough validity; do not invent a “tourist bridge” — see short-term vs long-term
  5. Stamp the TA — “no stamp duty on rooms” is a classic scam tell (renting process)

HDB also notes tenants may check whether owners listed them as authorised occupants after approval — use that if the agent stalls.

If you already moved into a bad setup

  1. Photograph the layout (partition, locks, who else sleeps there)
  2. Ask the owner for the current HDB approval PDF
  3. If approval is missing / owner absents / partition is the “bedroom”: seek written mutual termination + full deposit return
  4. CEA complaint if a salesperson marketed an unlawful arrangement
  5. Deposit refusal → SCT / diplomatic-clause guide after you have docs — not WhatsApp threats
