EP rejection appeal: candidate playbook

Companion to EP rejection / IPA — employer-only 3-month appeal window, how to read the advisory vs SAT folklore, when a cleaner refile beats a weak appeal, and why you should not resign on ‘appeal pending’ vibes.

Short answer: Employer-owned 3-month appeal — get the advisory in writing, add new facts, and do not resign on “we’ll appeal” vibes.

Parent map: EP rejection, appeal & IPA issuance. This companion is the candidate checklist Reddit collapses into “HR said they’ll appeal, so I resigned.”

Appeals are employer-owned

MOM’s appeal page is written for the employer / agent. Candidates cannot file a personal appeal email and expect a case ID. The published window is 3 months from rejection; most appeals process in about 6 weeks when the advisory is actually answered.

FolkloreSafer reading
“SAT said 90 — appeal will fix it”Self-Assessment Tool is planning input, not a veto override
“I’ll email MOM myself”Candidate enquiries are not the appeal channel
“Appeal pending = keep working”No IPA / cancelled pass ≠ work rights while you wait
“Resign now, appeal later”Weak appeals + no job leave you on visit status

Playbook before you burn bridges

  1. Get the rejection advisory text from HR (EP eService / letter) — not a verbal summary.
  2. Map each advisory line to a new fact: fixed salary, COMPASS inputs, degree campus proof, FCF ad ID / exemption, employer tax hygiene.
  3. Ask HR: appeal vs cleaner refile — sometimes a fixed-salary uplift + completed FCF clock beats a thin appeal.
  4. Do not resign overseas on “we’ll appeal” alone — keep a lawful stay / return plan.
  5. If the pass never issues, issuance clocks are irrelevant until approval — then career pivots sequencing applies.

Decision rule

No advisory + no new facts → no appeal theatre. Either fix the file or keep the current job / visit plan intact.

Questions, answered

Can I file an EP appeal myself as the candidate?
No. MOM’s appeal channel is for the employer or their agent. Candidate emails are not the appeal path — get HR to own the filing inside the published window.
How long do I have to appeal an EP rejection?
The published employer appeal window is 3 months from rejection. Many appeals take about 6 weeks when the advisory is actually answered — verify live MOM pages.
Does a strong SAT score mean the appeal will succeed?
No. The Self-Assessment Tool is planning input, not a veto override. Map the rejection advisory to new facts (salary, COMPASS, FCF, documents) before treating SAT folklore as a plan.
Should I resign while an EP appeal is pending?
Usually no. Appeal pending is not work rights. Resigning on ‘HR will appeal’ alone can leave you on visit status with a weak file and no job.
When is a cleaner refile better than an appeal?
When you have no advisory text or no new facts to add. A fixed-salary uplift plus a completed FCF clock often beats a thin appeal that restates the same file.
