FWA request refused: TAFEP escalation for EP / S Pass

Your employer owes a written reply to a formal FWA request within two months. If the process fails, raise an internal grievance first, then go to TAFEP.

The "HR ghosted my WFH email" threads on r/askSingapore almost always skip the part that decides how this ends: a formal FWA request, and a written reply to it within two months. How you file one, and what a rejection is allowed to say, lives on flexible work arrangement request. This guide is the layer after that. It's for when the process itself fails, written for people on an EP or S Pass who are weighing the pass against the cost of making noise.

Get one thing straight before anything else. TG-FWAR doesn't force your employer to say yes. It forces them to consider the request properly and to give you a decision in writing. That sounds weaker than you'd like, and it's more useful than it sounds, because a written decision is something you can point at months later and a shrug in a corridor is not.

Escalating in the order the Guidelines expect

Start with a formal request, not a message on Teams. Use the company form if one exists. If it doesn't, write your own pack with the date, the arrangement you want, how often, the reason, and the start and end dates. The formality is the whole point, because everything downstream turns on whether a request can be shown to have existed.

Then diary the two-month clock on the day you send it. The written reply is your employer's obligation, not a courtesy, and silence past two months is itself the thing you escalate.

If the answer is no, keep the written reason and read it carefully. There's a real difference between a rejection grounded in how the work actually gets done and one that amounts to "we have no FWA policy" — the second is a process failure wearing a business reason as a coat.

Take unresolved process concerns through your company's internal grievance channel first. TAFEP's own employee guide expects you to have done this, and skipping the step is the quickest way to have your complaint handed straight back to your employer anyway.

If you're a union member, your union is the next call. If you're not, TAFEP is the body that will engage your employer on whether the Guidelines were followed. And if what follows your complaint is a salary problem or a dismissal, that's a different door: TADM, not FWA folklore.

What TAFEP can and can't do for you

TAFEP is worth your time when a formal request has been ignored past two months, when the rejection cites personal bias or shows there was never any process, when the company has no formal FWA channel to use at all, or when you just need help engaging HR on what the Guidelines actually require.

It is not a button that forces through a month of working from Bali, and it's not immigration cover for working abroad on an EP. Overseas WFH is a separate stack of tax, destination-immigration and permanent-establishment risk, which the parent guide already flags. It also isn't a substitute for workplace harassment reporting when the conduct is harassment rather than process failure, and it isn't legal representation for a lawsuit.

The fear of what escalating does to your pass is real and worth planning around rather than arguing yourself out of. Line up the contingency: career pivots, or between jobs if it comes to that. What the fear shouldn't do is talk you out of creating the written record, because the record is the one asset you keep whichever way this goes.

The rule, in one line

Formal request, written reply inside two months, internal grievance, then TAFEP for the process gaps. Filing mechanics stay on FWA request; harassment goes through TAFEP harassment.

Questions, answered

My employer never replied to my FWA request. How long do they actually have?
Two months from the day you send a formal request. A written reply is your employer's obligation, not a courtesy, so diary the clock the day you file. Silence past two months is itself the thing you escalate.
Can TAFEP force my company to approve working from home?
No. TG-FWAR doesn't force your employer to say yes. It forces them to consider the request properly and give you a decision in writing, and TAFEP is the body that will engage your employer on whether the Guidelines were followed.
My rejection just says we have no FWA policy. Is that a good enough reason?
There's a real difference between a rejection grounded in how the work actually gets done and one that amounts to having no FWA policy at all. The second is a process failure wearing a business reason as a coat. Keep the written reason and take it through the internal grievance channel, then TAFEP.
Do I have to go through my company's grievance process before I contact TAFEP?
Yes, take unresolved process concerns through the internal grievance channel first. TAFEP's own employee guide expects you to have done this, and skipping the step is the quickest way to have your complaint handed straight back to your employer anyway.
Will an approved FWA let me work from Bali for a month?
No. FWA is not immigration cover for working abroad on an EP, and TAFEP isn't a button that forces that through. Overseas WFH is a separate stack of tax, destination-immigration and permanent-establishment risk.
I'm on an EP. Will escalating to TAFEP put my pass at risk?
That fear is real and worth planning around rather than arguing yourself out of. Line up the contingency now, whether that's a career pivot or the between-jobs route. What the fear shouldn't do is talk you out of creating the written record, because the record is the one asset you keep whichever way this goes.
