Workplace harassment for EP / S Pass holders

What to do when harassment hits on a work pass — HR first, TAFEP advice, PoHA / police for threats or assault, and how pass fear should not trap you.

r/askSingapore threads about sexual remarks in group chats, “jokes” about nationality, or a subordinate who will not stop after a clear no all share one myth: foreigners on EP/S Pass have no channel. Pass status does not delete workplace harassment protections. What it does change is the fear calculus — people stay quiet because the pass is employer-tied. Treat that fear as a planning constraint, not a legal veto — pass-clock plan: harassment pass fear on EP.

This is orientation, not legal advice. Threats, stalking, unwanted touching, or assault are police problems first.

What counts

TAFEP describes workplace harassment as behaviour that harasses, alarms, or distresses someone at work — including sexualised talk, humiliation, intimidation, and online harassment in work channels. The Tripartite Advisory on Managing Workplace Harassment expects employers to prevent and manage it; Protection from Harassment Act (PoHA) remedies sit alongside that advisory.

ChannelUse when
Internal HR / grievance / whistleblowingFirst written report, unless the harasser is that channel
Regional / HQ HRLocal boss or owner is the problem
TAFEPAdvice, employer engagement, policy gaps
Police (999 / report)Assault, threats, stalking, fear for safety
Protection orders / civil PoHALawyer / courts after criminal triage
TADM wrongful dismissalYou are fired after reporting

Evidence that survives “he said / she said”

  1. Dated notes: who, what, where, witnesses
  2. Screenshots of chats / email — export off company devices if you can do so lawfully
  3. Names of people who heard the same pattern
  4. Written “please stop / keep it professional” messages you already sent
  5. Medical notes if anxiety or injury is involved

Do not confront alone in a closed room. Buddy systems and written follow-ups beat Reddit revenge fantasies.

Pass anxiety — plan the clock, do not freeze

EP/S Pass cancellation follows employment end, not a TAFEP call. If you resign early to escape, you still owe notice or salary in lieu under the Employment Act (see leave & notice). If the company dismisses you after a good-faith report, TAFEP’s own list points to a wrongful dismissal path via TADM — salary / dispute rails. Secure a new IPA before you burn the old job when you can — career pivots. Deep dive: pass-fear plan.

MOM telling someone “pay short notice to leave” is about contract notice, not a finding that harassment is fine. Those are different questions.

Practical sequence most people skip

  1. Safety first — leave the space; call 999 if in danger
  2. Written report to HR (or alternate channel) with dates
  3. Contact TAFEP if HR stalls, is conflicted, or has no policy
  4. Parallel job search if the culture will not change
  5. Mental-health support — resources and mindline / emergencies
  6. Counsel if PoHA orders, settlement, or dismissal claims are live — entity: family/employment counsel category

Family violence at home is a different rail (PPO / NAVH) — family violence for foreigners.
