Retrenchment on an Employment Pass: benefits, notice, and STVP asks

Retrenchment benefit is not automatic under the Employment Act — contract vs TAMEM norms, TADM/TAFEP paths, final pay rules, and asking HR for the longest STVP on cancel.

r/askSingapore “I got retrenched on EP” threads conflate three questions: (1) what money am I owed, (2) how long can I stay, (3) can I keep working while I hunt. Only (2)/(3) are mostly immigration mechanics — covered in between jobs / STVP. This guide is the money + responsible-retrenchment rail.

Retrenchment benefit is usually contractual — not a statutory cheque

MOM’s responsible retrenchment page is blunt:

  • Retrenchment benefit depends on what is in your employment contract or collective agreement
  • If there is no provision, the quantum is negotiated
  • Tripartite norm (advisory, not a hard statutory entitlement): about 2 weeks to 1 month of salary per year of service, depending on company finances and industry
  • Employees with 2 or more years’ service are treated as eligible for retrenchment benefit under the advisory; those with under 2 years may get ex-gratia only
  • No CPF on retrenchment benefit (for those in CPF)
  • If a cut happened just before the exercise, use pre-cut salary to compute

The Employment Act does not invent a universal retrenchment payout the way some home countries do. Read your contract the night you get the letter.

What you can still demand on the last day

Regardless of retrenchment-benefit negotiation, MOM expects employers to pay all salaries due on the last day — including unused annual leave and notice pay (or salary in lieu) per contract / Employment Act coverage. See leave & notice.

Pass clock: notice is your hunting window

  1. While you are still employed (including garden leave / notice), the EP remains the work pass — use that time to interview.
  2. On cancellation, ask HR in writing to request the longest STVP MOM allows (peers often cite needing to ask for up to 90 days; silence gets the short default).
  3. You cannot work on STVP. IPA-before-start still rules — career pivots.
  4. Start IR21 conversations early — tax clearance.
  5. Map lease, schools, helper, and DP/LTVP knock-ons the same week.

Deep stay mechanics: between jobs STVP. If the runway is dead, switch to leaving playbook.

Negotiation notes that are not “entitlement”

  • Ask for outplacement, extended notice, or paid garden leave even when cash quantum is stuck — time is often worth more than a week of salary on EP.
  • Get the package in writing before you sign a release that waives claims.
